Afterschool Program Terms & Parent Acknowledgment
Welcome to the Brain Chase Afterschool Program!
When you click “I AGREE” to register your child for a Brain Chase afterschool program (the “Program”), you agree to be bound by these Afterschool Program Terms as of that date (the “Effective Date”). These Afterschool Program Terms are “Supplemental Terms” as defined in our Terms of Service, which is incorporated herein. Our Privacy Policy is also incorporated into this Agreement.
When we refer to a “child” or “student” in this Agreement, we mean the child you are registering for the Program. The term “you” means the parent or legal guardian who is registering the child and agreeing to this Agreement on the child’s behalf.
1. The Program.
Brain Chase afterschool programs are enrichment programs designed to engage students through puzzles, games, team competitions, physical challenges, escape rooms, problem-solving activities, and other age-appropriate educational experiences.
Program content, activities, schedules, and instructors may vary by school, location, and session.
2. Participation and School Rules.
Brain Chase Programs are offered in cooperation with participating schools. Students must follow all applicable school rules, policies, safety requirements, behavior expectations, and dismissal procedures while participating in the Program. School rules remain in effect during Brain Chase activities.
Brain Chase may remove a student from an activity or Program if the student’s behavior creates a safety concern, substantially disrupts the Program, or repeatedly violates school or Brain Chase expectations.
3. Program Activities and Assumption of Risk.
Brain Chase Programs may include movement, physical challenges, team competitions, games, puzzles, and other interactive activities.
You understand that participation in physical and group activities involves ordinary risks, including slips, falls, collisions, minor injuries, and other unexpected incidents. By registering your child, you voluntarily authorize your child to participate in these activities.
To the fullest extent permitted by applicable law, you release and hold harmless Brain Chase Productions, LLC, its employees, contractors, instructors, and agents from claims arising from the ordinary risks associated with participation in the Program, except for liability that cannot legally be waived.
4. Health, Safety, and Student Needs.
You agree to provide Brain Chase with information that its instructors reasonably need in order to help your child participate safely and successfully. This may include relevant allergies, medical needs, physical limitations, sensory needs, learning accommodations, behavioral considerations, or other information relevant to your child’s participation.
If an emergency occurs and you cannot be reached promptly, you authorize Brain Chase personnel to contact the participating school, your designated emergency contacts, emergency medical services, or other appropriate responders as reasonably necessary to protect your child.
5. Arrival, Supervision, and Dismissal.
Brain Chase is responsible for supervising participating students only during the scheduled Brain Chase Program and in accordance with the arrival and dismissal procedures established with the participating school.
You agree to follow all applicable school and Brain Chase procedures regarding arrival, pickup, dismissal, authorized adults, and transportation.
6. Program Changes and Cancellations.
Program dates, instructors, activities, locations, or schedules may occasionally change because of school closures, weather, instructor availability, enrollment levels, or other circumstances beyond Brain Chase’s reasonable control.
Brain Chase may cancel or modify a Program if minimum enrollment is not reached or if circumstances make the Program impractical or unsafe to operate. If Brain Chase cancels an entire Program, Brain Chase may provide an appropriate refund, credit, or other remedy based on the circumstances.
7. Refunds and Withdrawals.
Because Brain Chase makes staffing and program commitments based on student enrollment, registration fees are non-refundable once the first scheduled class of the Program has begun. Enrollment numbers are used to determine whether a Program can operate and to make commitments to instructors, schools, and other participating families. Allowing withdrawals with refunds after a Program begins could affect our ability to continue providing the Program for the remaining students.
If you need to withdraw your child before the first scheduled class begins, please contact Brain Chase as soon as possible regarding available refund options.
No refund will ordinarily be provided for missed classes, student absences, schedule conflicts, voluntary withdrawal after the Program begins, or removal from the Program because of repeated behavioral or safety concerns.
This policy does not prevent Brain Chase from issuing a refund, credit, or other accommodation when Brain Chase cancels a Program or when otherwise required by applicable law.
8. Fees and Payment.
By registering, you authorize Brain Chase to charge the payment method you provide for the applicable Program enrollment fees. Program pricing may vary by school, location, session, promotion, or other circumstances.
Unless otherwise stated during registration, enrollment is not confirmed until payment has been successfully processed.
9. Parent or Guardian Agreement.
By completing registration, you represent that you are the parent or legal guardian of the student being registered, or that you otherwise have legal authority to register the student and agree to these terms on the student’s behalf.
By clicking “I AGREE,” you confirm that the information you have provided is accurate and that you have read and agree to these Afterschool Program Terms, including the refund policy above, the Brain Chase Terms of Service, and the Brain Chase Privacy Policy.
