Brain Chase Library Challenge Contests – EDUCATORS’ EDITION

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. BY PARTICIPATING IN ANY OF LIBRARY CHALLENGE CONTESTS, PARTICIPANT AGREES TO ABIDE BY THESE RULES.

In a given year, Brain Chase sponsors four separate contests in four different locations during four different entry periods. At 3pm on the first day of the entry period for each contest, Brain Chase will post a clue on brainchase.com which points to a particular public library in the contest location and a book in that library that contains a key to unlock a treasure chest to a Grand Prize. One Grand Prize per contest will be offered (after verification) to the first eligible participant who unravels the clue, finds the book and notifies Brain Chase that they have found the key to the treasure chest.

I. ELIGIBILITY: The Contests are open only to legal residents of the forty-eight (48) United States and Washington, D.C., excluding US Territories, who are currently employed as a full-time elementary or secondary teacher or administrator at a public, charter, or private school. EACH PARTICIPANT AND MEMBERS OF WINNER’S IMMEDIATE FAMILY OR HOUSEHOLD MAY WIN ONLY ONE LIBRARY CONTEST AND WILL NOT BE ELIGIBLE TO CLAIM THE KEY OR GRAND PRIZE IN ANY FUTURE BRAIN CHASE LIBRARY CHALLENGE CONTESTS.  

Persons who reside in any of the U.S. territories, or outside the US, or who are not currently employed as a full-time educator are NOT eligible to enter the Contests. In order to enter a Contest, a participant must reside within 250 miles of the state in which the contest is occurring at the time the contest occurs. Employees of Brain Chase Productions, LLC, and their parent and affiliate companies as well as children of the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Contests are subject to all applicable federal, state, and local laws and regulations. CONTESTS VOID WHERE PROHIBITED BY LAW.

Participation constitutes each Eligible Participant’s and full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contests. Winning a Grand Prize is contingent upon fulfilling all requirements set forth herein.

II. ENTRY PERIOD: There is one distinct Entry Period for each Contest as shown in the Table below. Each Entry Period begins at 3pm in the time zone of the location of that contest on the Entry Start Date and ends as soon as Brain Chase receives notice and verifies that the key has been located by an eligible participant, or at 6:00pm in the time zone of the location for that contest on the Entry End Date, whichever comes first. If no valid entries are received by Brain Chase during the Entry Period for a Contest, no prize will be awarded in that Contest.

III. ENTRY INSTRUCTIONS: NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE. The sole method of entry in any of the four contests is by telephoning the phone number identified in the instructions found attached to a winning key. If you solve the riddle find one of the four winning keys, telephone the number provided with the key BEFORE 6pm of the Entry End Date for your Contest Location. Entries received after 6:00pm on the Entry End Date of your Contest Location will not be eligible for prizes.

Incomplete, false, misdirected, delayed, deceptive or garbled Entries are not eligible for prizes. Any Entry that does not comply with the Entry Requirements or otherwise with these Official Rules, as determined by Sponsor in its sole discretion, will be void, eliminated and not eligible for consideration. 

If entering via a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. 

After receipt of a phone call, representatives of Brain Chase will work with the potential winner to verify winner’s eligibility and to make arrangements for prize acceptance.

IV. WINNER DETERMINATION, NOTIFICATION AND ODDS: There will be four Grand Prize winners in total for the Library Challenge Contests, one winner per contest. Each Grand Prize Winner will receive $500 in cash. No participant may enter or win more than one of the four contests. Only one winner per family unit allowed. Winner must be a current full-time employed teacher or administrator at an elementary or secondary school. The winner must retrieve the key from the library in person.

The odds of winning depend upon the number of eligible participants in each Contest and the ability of those participants to quickly decipher the clues provided to find one of the four keys and to promptly notify Brain Chase before the Entry Period has ended. 

The first eligible participant in each Contest location to find the key and call Brain Chase during the Entry Period as per the instructions contained with the key will be deemed a potential Grand Prize Winner. In the event that any potential Grand Prize Winner cannot be verified to be eligible or is disqualified for any reason, the Grand Prize in that contest will not be awarded. Any inability to contact Brain Chase as instructed will result in forfeiture of such Prize. The Winners will be required to execute and return an Affidavit of Eligibility/Liability and Publicity Release within five (5) business days of attempted notification or the Winner may be disqualified.

Each potential four Grand Prize Winner will be notified by Brain Chase within 24 hours of the end of each Entry Period of their official Winner status and will be required within five (5) calendar days of the date Sponsor deploys the notice to privately (through email, or other secure, private means) provide his/her name, address, age and other personal information, and perform all other steps required by Sponsor and these Official Rules necessary to receive the Prize.  In the event that any potential Winner does not respond to such prize notification within the required response time or fails to provide Sponsor all information necessary to receive the Prize, the Entry will be void and the Participant will be disqualified and forfeit the Prize, and at Sponsor’s sole discretion and time permitting, an alternate potential Winner shall be chosen from among all remaining eligible Entries. If Sponsor determines, in its sole and absolute discretion, that any Participant has not complied with these Official Rules in any way, the Sponsor reserves the right to disqualify that Participant and void his/her Entry(ies). The decisions of Sponsor in respect to all aspects of the Contests and these Official Rules are final, binding and not subject to challenge and/or appeal.


VI. PRIZES: Each Grand Prize Winner will receive $500.00 in American dollars, Total Prize Pool ARV is $2,000.00.

VII. PRIZE TERMS AND CONDITIONS: The potential Grand Prize Winners must prove eligibility, including, without limitation, proof of employment as a full-time teacher or administrator within five (5) days of being notified as a potential Grand Prize Winner. A potential Grand Prize Winner must also sign the following documents within ten (10) days of receipt from Sponsor: (a) an affidavit of eligibility and release of Sponsor and its subsidiaries, affiliates, agents, suppliers, distributors and prize suppliers, and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”), from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with these Contests or the use/misuse or acceptance of the Grand Prize (as hereinafter defined) or any portion thereof; and (b) except where prohibited by law, a promotional release granting Sponsor the right to use Winner’s name and likeness for advertising and publicity purposes, including personal appearances on radio and television shows, without additional compensation and (c) any other documentation required by Sponsor, including a W2 form and Grand Prize Winner’s social security number for tax purposes (collectively, the “Releases”). Entry into any of these Contests constitutes agreement to sign such Releases. The Grand Prize Winner also must acknowledge that Sponsor has not and will not obtain or provide insurance of any kind relating to the Grand Prize and that Grand Prize Winner will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Grand Prize. The potential Grand Prize Winner must also complete any additional legal documents provided by Sponsor (or third party on its behalf, if applicable) with respect to the Contests or the Grand Prizes and return them as instructed within the time frame specified by Sponsor. Failure to complete and return all such releases and documents and comply with Sponsor’s deadlines or other noncompliance with these Official Rules, or the rejection or return of any prize or prize notification may result in disqualification and forfeiture of the prize, in Sponsor’s sole discretion. 

VIII. PUBLICITY: Except where prohibited, participation in any of the Contests constitutes Winner’s consent to Sponsor’s and its agents’ use of Winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. Entrants agree that we may show up at a potential Winner’s home to announce the prize, and we may film this. The potential Winner must also agree to participate in reasonable promotional media appearances to be identified in the future. 

IX. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Contests, or any part of them, if any fraud, technical failures or any other factor (including an event of force majeure, as defined below) beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contests or the awarding of the Grand Prizes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contests or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contests may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

An event of force majeure is an event or circumstance which is beyond the control and without the fault or negligence of the Sponsor and which by the exercise of reasonable diligence the Sponsor was unable to prevent provided that event or circumstance is limited to the following:

(a) riot, war, invasion, act of foreign enemies, hostilities (whether war is declared or not) acts of terrorism, civil war, rebellion, revolution, insurrection of military or usurped power, requisition or compulsory acquisition by any governmental or competent authority;

(b) ionizing radiation or contamination, radio activity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive or other hazardous properties of any explosive assembly or nuclear component;

(c) pressure waves caused by aircraft or other aerial devices traveling at sonic or supersonic speeds;

(d) earthquakes, flood, fire, hurricane or other physical natural disaster or severe weather event, and

(e) strikes at national level or industrial disputes at a national level, or strike or industrial disputes by labor not employed by Sponsor, and which affect an essential portion of the Contests or the Grand Prizes.

X. DISCLAIMER OF LIABILITY: Neither Sponsor nor its agents are responsible for:  (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contests; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contests; (4) technical or human error which may occur in the administration of the Contests or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail and email; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contests or receipt or use or misuse of any prize.  If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that the Entry Period has not ended. No more than the stated number of prizes will be awarded. 

XI. DISPUTES: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, any of the Contests or any prize awarded shall be resolved in accordance with the Dispute Resolution provision of the Terms of Service, available here

XII. RELEASE:  By entering these Contests, Participants agree that none of Released Parties shall be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Contests or acceptance of or use of or inability to use the prize or parts thereof, including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner releases Sponsor from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death). Winner acknowledges that Sponsor has neither made nor is in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.

XIII. GOVERNING LAW/DISPUTES: By participating, Participants agree to be bound by the Official Rules, Sponsor’s Website Terms of Use (if any and if applicable to Entrant’s method of participating), and the decisions of Sponsor, which are final and binding in all respects. The Contests and these Official Rules shall be construed and governed in accordance with the laws of the State of Texas.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Participants, Sponsor, or the Released Parties in connection with the Contests will be governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other states’ laws. 

Except where prohibited, as a condition of participating in these Contests, the parties agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with these Contests, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Participant ‘s actual out-of-pocket expenses (e.g., costs associated with entering any of the Contests), and Participant further waives all rights to have damages multiplied or increased. The arbitration shall be conducted in the State of Texas, in the City of Austin, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.  The arbitrator will apply the substantive laws of the state of Texas, will issue a written decision and will have the power to award any legal remedies except as limited by these Official Rules. The parties will split the arbitrator’s fee; provided, however, if applicable law requires Sponsor to pay the arbitrator’s fee in order for the arbitration provision to be enforceable, Sponsor shall have the discretion to elect to pay such fees and proceed to arbitration. Participant irrevocably waives any right to bring or join in any class action regarding the Contests. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof.  This arbitration provision shall be deemed to be self-executing, and in the event that any party fails to appear to any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear. 

BY ENTERING ANY OF THE CONTESTS, PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIFTY ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (2) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED  FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. 

XIV. ENTRANT’S PERSONAL INFORMATION: Information collected from entrants is subject to Sponsor’s Privacy Policy. 

XV. WINNER LIST/OFFICIAL RULES: For a Winner List or a copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope to “The Brain Chase Library Challenge”, 2200 Alexander Ave. Austin, TX 78722. Please indicate which document(s) you would like to be sent. Winner List requests must be received by 3/31/2017. VT residents may exclude return postage for Official Rules.
